Terms and Conditions

§ 1 Scope of Application
For the business relationship between Velos-Motos Keller and the ordering party, only the following General Terms and Conditions in their version valid at the time of the order shall apply. Deviating terms of the ordering party are not recognized by Velos-Motos Keller, unless Velos-Motos Keller has expressly agreed to their validity in writing.

§ 2 Conclusion of Contract
Offers of any kind are always subject to change and non-binding, unless they are expressly designated as fixed offers by Velos-Motos Keller. They are valid while supplies last. We reserve the right to deliver an equivalent product in case of unavailability. You will be informed immediately in this case. All orders are only considered as conclusively accepted when they are confirmed in writing or by delivery with invoicing.

§ 3 Shipping and Delivery
Velos-Motos Keller is always striving to meet the specified delivery dates. However, these are non-binding. Delivery usually takes place within 3-4 business days. The shipping is done against advance payment or cash on delivery unless otherwise agreed. The type of shipping and the carrier are determined by Velos-Motos Keller. In case of delays, you will be informed via email about the approximate delivery date.

§ 4 Agreement on the Condition
The condition of the purchased item underlying the contract results exclusively from the manufacturer's specifications in the respective operating instructions. Deviations require a written agreement.

§ 5 Prices, Due Date, and Payment
For the end consumer, the prices are calculated, unless otherwise agreed, at the prices valid on the day of the order. Price indications are final prices in CHF (Swiss Francs) and include the statutory value-added tax. Costs for packaging, shipping, and cash on delivery charges are not included in the price indications. These costs will be charged separately. Invoices from Velos-Motos Keller are immediately due for payment without deductions unless a different payment date is specified on the invoice. A payment is only considered completed when the amount due has been credited to the bank or postal check account of Velos-Motos Keller.

The following payment options are available:
Cash Payment: You pay in cash at our store when picking up the goods, by EC card or by postcard.
Invoice: (only for registered customers from Switzerland/Liechtenstein) You pay for the goods within 10 days after receipt according to the invoice included with the goods.
Credit Card/Paypal/Yellowpay: The effective invoice total will be calculated online and charged to you by your card partner.
Cash on Delivery (only Switzerland/Liechtenstein): You pay the invoice amount to the delivery person upon arrival of the goods.
Prepayment: You pay in advance directly to our bank or postal check account. Please note that you must bear any bank fees to ensure the full amount reaches us.

§ 6 Warranty and Liability
The customer has the duty to inspect and examine the items. Velos-Motos Keller is not liable for damages resulting from uninspected goods that have been passed on, nor for the suitability of the delivered goods for purposes intended by the customer, nor for damages that may arise from the processing and use of the goods.
The bicycles and trailers supplied by us are pre-assembled for shipping. Velos-Motos Keller assumes no liability for final assembly.
Velos-Motos Keller limits its liability in legally permissible cases to the delivered item itself and therefore does not assume liability for damages not arising from the delivered item itself; in particular, Velos-Motos Keller is not liable for loss of profit or other financial losses of the ordering party.

§ 7 Right of Return and Money-Back Guarantee:
Returns will only be accepted after prior agreement/consent. Returns will only be accepted if they are in pristine condition and in their original packaging. In case of an agreed return, the paid sale price (excluding shipping/packaging costs) will be refunded. Damaged goods will not be accepted. Unpaid returns will not be accepted. The return is at the customer's risk and the return shipping costs will not be refunded. Shipping/packaging costs for delivered goods that are returned by the customer remain due in any case.
The right of return does not apply to goods that we have modified or custom-made for you. This includes, for example, our modular systems as well as bicycles with custom options.

§ 8 Consequences of Return:
The purchase contract is dissolved after the return or take-back of the goods and we will refund any payments made within 30 days by bank transfer, after deducting any costs incurred due to an incorrect return. The consumer must bear the costs of any decrease in value if this is not exclusively due to the inspection of the ordered goods as would have been customary in a retail store. Furthermore, you can avoid any obligation to reimburse the value by not using the goods as an owner and refraining from anything that impairs their value.

§ 9 Validity of Contract Provisions
The invalidity of one or more provisions of these General Terms and Conditions does not affect the validity of the remaining provisions.

§ 10 Applicable Law
For all contracts concluded with us, the jurisdiction shall be: CH-8580 Amriswil.
Swiss law shall exclusively apply to the entire business relationship.
